Welcome to TocToc AI ("TocToc AI", "we", "us"), the toc toc dance generator available at toctocai.org. These Terms of Service ("Terms") are a contract between you and us. By creating an account, uploading a photo, buying credits or otherwise using the service, you accept these Terms, our Acceptable Use Policy, our Privacy Policy and our Cookie Policy. If you do not agree, please do not use TocToc AI.

1. What TocToc AI does

TocToc AI lets you upload one photo of a person or a pet and receive a short AI-generated dance video in the style of the "toc toc" hallway dance trend. Videos are produced by third-party generative video models that we connect to. The service is offered as is and may change as models and features evolve.

2. Who can use it

You must be at least 18 years old, or the age of majority where you live, to create an account and buy credits.
You must give accurate information when you sign up and keep your login details secure. You are responsible for everything done through your account.
One person may not run multiple accounts to get around limits, refunds or enforcement actions.

When you upload a photo you confirm that:

you are the person in the photo, or you have that person's clear permission to turn their likeness into a dance video;
if the person is a minor, you are their parent or legal guardian, and the result will not be sexualised, humiliating or otherwise harmful (see Section 6);
you own the photo or have the rights needed to use it; and
the photo and the video you create do not break any law or any rule in Section 6.

Pet photos are welcome. Animals are shown photorealistically, dancing upright on two legs like a person; please only upload pets you own or have permission to feature.

4. Credits, plans and payment

Each video costs the number of credits shown next to the Generate button before you start.
Credits are sold as one-time video packs or as monthly or yearly subscriptions. Pack credits do not expire. Subscription credits are added each month and unused subscription credits expire at the end of that month.
Payments are processed by Waffo, our Merchant of Record and reseller. Waffo handles checkout, taxes, invoices and subscription billing, and its own terms apply to the payment. You can manage or cancel a subscription at any time from the Billing page; cancellation stops future renewals and keeps your current period active until it ends.
Prices are shown in US dollars and may be converted at checkout. We may change prices for future purchases; existing purchases are not affected.

5. Refunds and failed videos

If a video fails to generate, the credits it used are returned to your balance automatically.
Because each video consumes paid AI computing as soon as it is created, credits used on successfully generated videos are not refundable.
Unused one-time packs can be refunded within 14 days of purchase if no credits from that pack have been used. Contact us through the contact page with your purchase email.
Refunds approved by us or by Waffo remove the credits granted by that payment.

6. AI-generated content standards (Acceptable Use)

This section is a summary of our Acceptable Use Policy, which forms part of these Terms. It applies to every photo you upload and every video you generate, download or share.

6.1 Prohibited content categories

You must not use TocToc AI to upload, generate or distribute content that falls into any of these six categories:

Sexual or NSFW content – nudity, sexual acts, sexually suggestive poses or fetish content, or photos of people in underwear or swimwear uploaded to obtain such results.
Violence and gore – graphic injury, blood, death, torture, self-harm, cruelty to animals, or content that glorifies, threatens or incites violence.
Hate speech and harassment – content that attacks, demeans or mocks people based on race, ethnicity, nationality, religion, caste, sex, gender identity, sexual orientation, disability, age or serious illness; extremist symbols or propaganda; bullying or humiliating a real person.
Child safety (CSAM and child-unsafe content) – any sexual, sexualised, suggestive or exploitative depiction of anyone under 18, or any content that endangers a child. We have zero tolerance: such content is removed, the account is terminated permanently and we report it to the National Center for Missing & Exploited Children (NCMEC) and to the competent law-enforcement authorities.
Deepfakes and impersonation – using someone's face without their consent; depicting public figures, politicians, celebrities or private individuals in a misleading way; content designed to deceive, defraud, defame or pass the video off as real footage of a real event; misleading political or election content.
Copyright and trademark infringement – photos you do not have the right to use, copyrighted characters (film, TV, anime, game) or other people's artwork, and logos or brand marks used in a way that suggests endorsement or infringes trademark rights.

Also prohibited: content that facilitates illegal activity, spam or malware, attempts to bypass our safety filters (for example with prompt tricks, cropping or edits), and scraping, reselling or automated access to the service without written permission.

6.2 How violations are handled

When we find or are told about content that breaks these rules, we act in proportion to the seriousness of the violation:

Removal – the photo and video are deleted from our storage and from your History.
Warning – for a first, minor violation we may send a warning to your account email.
Restriction – we may block further generations or purchases while we review an account.
Suspension or termination – serious or repeated violations lead to account suspension or permanent termination. Credits on an account terminated for a violation are forfeited and not refunded, to the extent permitted by law.
Reporting to authorities – child sexual abuse material, credible threats and other illegal content are reported to law enforcement and relevant organisations, and records are preserved as the law requires.

If you believe we made a mistake, reply to the enforcement email or use the contact page within 30 days and a person will review the decision.

6.3 How to report content

Anyone, with or without an account, can report a TocToc AI video or upload:

use the contact form with the "Report content" topic, or
email support@toctocai.org with the subject "Report content".

Please include a link or description of the video, why it breaks the rules and, for impersonation or copyright reports, how you are connected to the person or work. We acknowledge reports within 48 hours and prioritise child-safety and impersonation reports. Copyright owners may also send notices under Section 8.

6.4 How we moderate content

Automated filters – every photo and every generated video passes through the safety systems of the AI model providers we use, which block sexual, violent, child-unsafe and copyright-flagged inputs and outputs. Blocked generations fail and their credits are returned.
Fixed choreography – videos follow one predefined dance and do not accept free-text prompts, which limits the kinds of content the service can produce.
Human review – reported content and accounts with repeated blocked generations are reviewed by our team, who can see the uploaded photo and resulting video for that purpose.
Account controls – we can remove content, block generation and suspend or ban accounts, and we keep enforcement records to stop banned users from returning.

No filter is perfect, so you remain responsible for what you upload and share.

7. Ownership of your videos

You keep whatever rights you have in the photos you upload.
Subject to these Terms and the third-party rights described below, you may use the videos you generate for personal and commercial purposes, including posting them on social media.
You give us a limited licence to store, process and display your photos and videos only to run the service for you, to keep it safe (including moderation under Section 6) and to comply with the law. We do not use your photos or videos in our marketing without your separate permission.
The audio in each video comes from the original toc toc trend. Social platforms may apply their own music rules to clips containing it, and we do not grant rights in that audio.
AI output can be similar for different users; we cannot promise that a video is unique or protectable.

8. Intellectual property and copyright notices

The TocToc AI name, site design, code and text belong to us or our licensors. If you believe content on TocToc AI infringes your copyright or trademark, send us the work concerned, the content you believe infringes it, your contact details and a statement that you are the rights holder or authorised to act for them, using the contact form. We remove infringing content and terminate repeat infringers.

9. Service availability

We aim to keep TocToc AI available and fast, but rendering depends on external AI providers and can be slow or unavailable at times. We may change, suspend or discontinue features. If we shut the service down entirely we will give reasonable notice and refund unused one-time pack credits.

10. Disclaimers

The service and all generated videos are provided "as is" and "as available". AI output can be inaccurate, unflattering or different from what you expected. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to defend and compensate us for claims, losses and costs (including reasonable legal fees) that arise from content you upload or share, your breach of these Terms, or your violation of anyone's rights.

13. Ending your account

You can delete your account at any time from Settings. Deleting your account removes your photos and videos from our storage. We may suspend or terminate accounts as described in Section 6.2 or if required by law. Sections that by their nature should survive termination (such as 7, 8, 10, 11 and 12) continue to apply.

14. Changes to these Terms

We may update these Terms when the service or the law changes. We will post the new version here with a new date and, for material changes, notify you by email or on the site. Continuing to use TocToc AI after the change means you accept the new Terms.
